Alito Moreno Corruption File Disappeared, Attorney General’s Office Never Charged Him

Editor’s Note: We are publishing this article with a note to readers that an August 4th editorial we translated and re-printed by Miguel Ángel Velázquez identified the interviewee Hugo Eric Flores, a Morena member in the Chamber of Deputies and responsible for the investigation which could determine the status of PRI President Alito Moreno’s immunity as being capable of “seeking some legal trick to save Alito’s head.” Mr. Flores is a neo-Pentecostal pastor who has previously been a member of both PRI and the PAN, as well as the President of the Social Encounter Party before recently joining Morena.

Mexico City. Hugo Eric Flores Cervantes, President of the Investigative Section of the Chamber of Deputies, the body in charge of evaluating the impeachment of Alejandro “Alito” Moreno Cárdenas, revealed that the file on the alleged diversion of 83 million by the PRI member disappeared, and at the same time pointed out how the Attorney General’s Office (FGR) never requested that his constitutional immunity be removed.

In an interview with Alejandro Páez and Álvaro Delgado on the program Los Periodistas, broadcast on the SinEmbargo Al Aire YouTube channel, the Representative explained that at the beginning of the 66th Legislature, the Investigative Section reviewed all the files and found only one document related to the investigation against “Alito.”

“When we arrived at this legislative session, we didn’t find it as a pending issue, and reviewing all the files, we only found one document, and it caught our attention. This document basically stated that the matter hadn’t been filed, and then, since some suspensions had been filed because they were seeking substantive injunctions, one document was all that existed.”

Flores Cervantes said that during their investigation, they found some very relevant documents and later indicated that it took several months to find the boxes containing the request. “They were in different places, even in the dead file, not in the delivery and reception area. There was a bureaucratic scramble there; there was even annoyance with us because we were trying to explain why there was only one piece of paper, there was nothing else, there was nothing else on this matter, and it’s obviously a relevant issue from a legal perspective, but also from a public opinion perspective.”

The President of the Investigative Section explained that in the only document found, “Alito” told the Board of Directors of the Chamber of Deputies that he had supposedly won some injunctions, which led to the Chamber declaring that the matter was not substantive and, therefore, was not assigned or sent to a specific legislative committee for study and resolution.

“What documents did we find? This is all there was. A document where ‘Alito’ tells the Board of Directors that he won some injunctions. The Board of Directors tells the president of the Judicial Commission (that Moreno Cárdenas won some injunctions, and so he doesn’t file, but this issue of not filing doesn’t exist in the terminology of administrative law; it’s not included in the federal law. Filing is done automatically; you can admit or dismiss a case.”

Representative Hugo Eric said that the Investigative Section should have prepared a report and subsequently decided whether to admit or dismiss it. “No letter from the president of the Investigative Section committee was ever submitted to the Board of Directors, and the matter was shelved.”

On August 17, 2022, the Campeche Prosecutor’s Office requested for the first time that “Alito” Moreno’s constitutional immunity be revoked for alleged crimes of illicit enrichment, embezzlement, misuse of powers, tax evasion, and money laundering during his tenure as Governor of that state. The case was unsuccessful and remained on hold.

In addition, the Attorney General’s Office (FGR) investigated him for illicit enrichment, embezzlement of federal funds, tax fraud, use of illicit funds, and influence peddling. This FGR investigation is separate from the one being conducted by the Campeche Prosecutor’s Office, also for alleged illicit enrichment, a crime punishable by up to 25 years in prison.

However, Hugo Eric Flores Cervantes stated that the Attorney General’s Office “never filed any request to strip then-Representative Alejandro Moreno of his constitutional immunity.”

“There is no request from the Attorney General’s Office in the files. The only one, and this is something that must be said, because I’ve also read notes. We’ve delved deeply into the case, and there are many notes that mention a request from the Attorney General’s Office, but it never reached the Chamber of Deputies. It must be said, it never reached the Chamber of Deputies, and it only remained in the press,” the Representative elaborated.

Hugo Eric Flores explained that the process of declaring his legal origin is not new, but rather dates back to 2022, at the request of the Campeche State Attorney General’s Office for illicit enrichment. He explained that because the previous request sought to remove his immunity as a Representative, a new one had to be submitted requiring the removal of the protection he now enjoys as a Senator. “That request called for the Representative’s constitutional immunity to be removed, and today he is no longer a Representative, he is a Senator.”

Flores maintained that this declaration of provenance dates from 2022. “It’s a request from the Campeche State Attorney General’s Office for illicit enrichment. This is basically on hold because he obtains some injunctions, I say, they are injunctions for purposes only. No judge, no court, has ever exonerated him of the crime he was charged with. This is very important to mention because the current senator permanently maintains that he has already been exonerated.”

The legislator also indicated that the proceedings against “Alito” have not proceeded due to improper procedures during the search of one of his properties in 2023.

“What happened with those proceedings? Why does he win these injunctions? Because there were some improperly conducted proceedings during that famous search of his house, because it was public, there were procedural problems with that search. So, he goes to a constitutional trial, and he wins because there were indeed some problems, such as wrong addresses, a search of a property that wasn’t there, basically procedural issues, which must be said, and that’s why he wins.”

How would “Alito” be stripped of his immunity?

According to Article 111 of the Constitution, Alejandro Moreno Cárdenas is protected by constitutional jurisdiction. To be tried, a declaration of legal standing from the Chamber of Deputies is required.

For Senator Gerardo Fernández Noroña’s complaint to be successful, the law establishes a series of steps to follow. The Attorney General’s Office must then request the removal of immunity from the Chamber of Deputies. Once the request is submitted, it will be referred to the Investigative Section of the Lower House.

The Investigative Section must conduct the necessary investigations to establish the existence of the crime and the probable responsibility of “Alito” Moreno. The law grants it 60 business days to issue a ruling, although this period may be extended. The ruling will determine whether criminal proceedings may be brought against the legislator.

If the Investigative Division determines that there are grounds for the case, the Chamber of Deputies will establish a Jury of Origins. A hearing will be convened in which the parties—the complainant, the Public Prosecutor’s Office, and Moreno himself and his defense—will present their arguments.

After the hearing, and with the ruling on the table, the Chamber of Deputies will discuss and vote on the resolution. An absolute majority of the members present is required to declare that there is cause to proceed against the representative.

If the vote is affirmative, “Alito” Moreno will be removed from office immediately and subject to the jurisdiction of the criminal courts.
