Mexico’s Consumer Protection Agency Setting New Guidelines for Ticket Sales

The Federal Consumer Protection Agency (PROFECO) is preparing a series of guidelines to regulate the sale of tickets for mass events in Mexico so that attendees know the exact prices and characteristics of the seats and places that are acquired through digital platforms.
In a morning press conference, the head of PROFECO, Ivan Escalante, reported that the regulations being worked on require ticketing companies to clearly inform, at least 24 hours in advance of the first sale, details such as the place, date, times, artists, as well as the map of the venue with the sections and the number of seats available.
The regulations also stipulate that the total price per section must be transparent and cannot be increased at the time of purchase. In case of cancellation, companies must inform customers of the refund process.
Companies must notify organizers of any changes to the event conditions 24 hours in advance. Furthermore, the pre-selection of additional services is prohibited; these services must be strictly optional and not a requirement for ticket purchase, as is the case with VIP packages.
The head of PROFECO announced these guidelines as a follow-up to the sale of tickets by the South Korean group, BTS , where PROFECO maintains a Procedure for Infringement of the Law (PIL) against Ticketmaster for irregularities in the sale of tickets, due to the prices and high demand of these that also circulated in digital resale companies.
In this regard, Escalante said that Ticketmaster was notified on February 11 and has until February 17 to present its arguments, after which the authority will determine the administrative resolution and the amount of the fine.
Digital reseller companies were also contacted to ensure they adjusted their services to comply with current Mexican regulations.
